Carriage Contract

Guangdong XinHang Cross-border E-commerce Logistics Co., Ltd. mainly provides consolidation and related services (hereinafter referred to as the "Company"):

1. Users of the Company's services must agree to and comply with the following rules and terms. The Company is not responsible for delays, loss, destruction or confiscation of items caused by force majeure, such as war, riots, severe weather, flight delays, air crashes, typhoons, fire, floods, major traffic accidents, serious natural or man-made disasters, and various situations beyond the Company's control, or confiscation caused by the shipper or the customer's reasons. 

The Company shall not bear any compensation liability for indirect losses or other non-substantial losses caused by delays or loss of items during transportation.

(1)If items are damaged or lost during express transportation, all compensation to the customer shall be based on the compensation standards of the express company.

(2)For goods delayed due to customs clearance or weather, or confiscated by customs, the Company will not refund the shipping fee, nor bear any related losses.

(3)If goods cannot be delivered to the XinHang International warehouse, the resulting pickup fees shall be borne by the customer. 

2. The Company shall not be liable for any delays, delivery errors, or losses caused by the following reasons:

(1)Due to customer reasons, such as incorrect or incomplete address, wrong phone number, etc.; change of recipient address or undeliverable areas, etc.

(2)Due to the items consigned by the customer themselves violating relevant national policies and laws, such as flammable, explosive, contaminating, corrosive, toxic powders, liquids, and other dangerous goods.

(3)Various losses caused by the shipper or customer's undeclared or improperly packaged items. As the Company only receives goods on behalf and dispatches them after consolidation, if the goods are not properly packaged by default, do not meet the requirements for safe transportation, or for special material items (such as important items, fragile items, etc.) that are not marked to the Company, the damage and the resulting liability shall be borne by the customer.

3. To protect customer rights, except when required by government departments and express companies to inspect consigned items or the Company's periodic random sampling inspections, the Company will not unseal the package of the goods for quantity verification or quality inspection when signing for the goods on behalf of the customer. The Company shall not bear any compensation liability for losses caused by the quantity, nature, or characteristics of the items.

4. The customer is obliged to maintain good communication with the seller to ensure that the consigned goods are provided with sufficiently durable, strong, and thick inner and outer packaging or containers to prevent damage or loss due to improper packaging during transportation; the packaging should be equipped with adequate and appropriate protective materials, and the outer packaging or container should be integrated with the protective materials, cushioning materials, and contents; if there are multiple items, there should be no sound caused by rubbing, collision, squeezing, or shaking between the contents and the inner wall of the outer packaging. If it is found that damage occurs during transportation due to improper packaging, the Company will not provide any compensation.

5. If the consigned goods are fragile items such as ceramics, glass products, special handicrafts, or easily bendable goods, the customer is obliged to ensure the following:

(1)Good outer packaging: Ensure the consigned items are properly packaged in a container with sufficient durability and strength to protect them from damage during transportation, such as using a sturdy box and nailing the outer box with a wooden frame to ensure the outer box can withstand certain pressure.

(2)Good inner packaging: Ensure that the interior of the packaging is equipped with shockproof cushioning materials, and each fragile item must be individually wrapped with sufficient thickness of foam or bubble wrap and other shockproof materials.

(3)Both inner and outer packaging must be equipped with sufficiently durable, strong, and thick protective materials.

(4)Warning labels: Ensure that warning labels such as "Fragile – Handle with Care", "Fragile", "Handle with Care" are affixed in Chinese at conspicuous places on the outer packaging. For goods easily damaged by bending, "Do Not Bend" warning labels should be added, noting: Fragile items are not eligible for compensation. If any damage or loss occurs during transportation due to any of the above packaging deficiencies, the Company will not provide any compensation. 

6. The collection of customers' personal data is solely used for the Company's delivery, contact, and marketing purposes, and shall never be submitted to third parties or institutions. 

7. The Company has the right to waive or refuse to accept items unsuitable for express transportation, items whose true name and value are intentionally or unintentionally concealed, and items prohibited by national laws for carrying, mailing, and transportation. Once violated, the customer is willing to bear all resulting legal and economic compensation liabilities. 

8. By paying the shipping fee, the customer indicates acceptance and compliance with the terms of this contract and guarantees that the consigned items comply with national laws and can be accepted by the express company. The Company refuses to accept the following items for shipping:

(1)Flammable, perishable, toxic, explosive, lethal, corrosive, or radioactive dangerous goods; 

(2)Drugs, infectious or items hindering public health, narcotics, or drug-related paraphernalia;

(3)Obscene books, photos, sculptures, or devices;

(4)Items infringing on trademarks, copyrights, or intellectual property rights;

(5)Currency, VAT invoices, other tax documents or securities, gold, silver, treasures, antiques, precious metals (gold, silver, rare precious metals);

(6)Live animals, plants, or seeds;

(7)Personal identification documents, contracts, approvals, customs documents, or correspondence of a communicative nature; ? Reactionary political publications, books, videos, or photos;

(8)Electronic products;

(9)All powders, liquids, pastes, and discs;

(10)Non-genuine/counterfeit goods or items of incorrect origin;

(11)Improperly packaged, fragile items that may endanger personal safety, contaminate or damage other mail equipment;

(12)Surplus foreign trade goods; ? Items suspected to be non-genuine branded products. If described as genuine but priced unreasonably low;

(13)Prohibited items subject to Hong Kong Customs import control, such as food or Chinese medicinal materials, etc.;

(14)Goods that do not comply with the laws of Hong Kong, the Law of the People's Republic of China on the Protection of Consumer Rights and Interests, and other administrative regulations, departmental rules, and national mandatory standards; 

9. The Company has the right to waive or refuse to accept items unsuitable for express transportation, items whose true name and value are intentionally or unintentionally concealed, and items prohibited by national laws for carrying, mailing, and transportation. Once violated, the customer is willing to bear all resulting legal and economic compensation liabilities. If any liquid or solid spills, seeps, or leaks out of the customer's goods, or if due to various factors such as improper packaging or the nature of the goods themselves, other goods are contaminated or damaged, the Company has the right to pursue all legal and economic compensation liabilities from the customer. 

10. The Company has the right to be informed of the nature, product name, quantity, weight, etc., of the consigned items to assist relevant government departments and express companies in inspecting the consigned items. Items sent via the Company will be randomly sampled by the express company. If the items do not meet the requirements of the "Carriage Contract Terms", the Company has the right to refuse transportation. The Company shall retain the consigned items and reserve the right to claim compensation from the customer, and shall not bear any compensation liability for any losses arising from this.

11. Goods are stored free of charge in the China warehouse for 180 days. Beyond 180 days, storage fees will be incurred, calculated at RMB 0.5 per item per day. Goods stored for more than 12 months will be automatically destroyed according to China's express delivery laws without the need to notify the member. If the express company has been unable to contact the customer after the goods arrive, the goods may be returned or stored in the logistics warehouse, and any resulting shipping costs shall be borne by the customer.
